Ethical and Legal Aspects of Nursing Assistance in Adoption

History clearly shows that adoption is not a postmodern practice and process within that family health professionals are fully interconnected, as should assist in all spheres of Caution1. The adoption process has gone through several changes and enhancements to reach the creation of the child’s status and adolescents (ECA). This study aimed to describe the ethical and legal aspects involved in the adoption, and the nurse’s role within the foster process2. For this purpose, were found fourteen potential references and after reading were used six articles and a monograph as well as official documents and two supplementary books. The adopted publication period was 1998-2013 and the databases consulted were the LILACS and SciELO. According to the Brazilian Civil Code, to happen adoption is necessary compliance standards to ensure that the adopted is being well received in accordance with current ECA laws in addition to the provision and acceptance of adopters of caring for the child newcomer, in which the nurse is closely linked to the welfare of those involved in question, since it is a professional committed to the quality of life of the individual, family and collectivity3,4. An important assignment of nurses within the adoption process is in its inclusion in multidisciplinary or interprofessional team, to evaluate the interaction of children and adolescents placed in a foster family. According to the legislation, the health care provider has a duty to assist the pregnant woman or mother during the pre and post natal, thus it interfere in a direct way in the adoption, guaranteeing the right decision with mother’s responsibility to express the desire to deliver the child to the adoption and guarantee the rights of the child to be adopted and assistance in the inclusion of the same in his/her new família5,6. This article shows it is relevant because it allows both equip society as a multidisciplinary team with the issues concerning the topic and seeks to expand and update the knowledge of a bureaucratic process and complicated that requires patience as well, knowing the scientific contributions which have been published.
